General
1. Entry into this program is deemed acceptance of these Terms and Conditions.
2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this promotion, these Terms and Conditions shall prevail.
Who can enter
3. The Promoter is Cover-More Insurance ServicesPty Ltd (ABN 95 003 114 145) of 118 Mount Street, North Sydney NSW 2060 trading as Freely (Promoter).
4. Subject to clause 4, entry is open to all Australian residents who are over the age of 18 years, as at the date of entry, and who have fulfilled the requirements set out below.
5. Employees, and their families, of the Promoter are eligible to participate in this Program
How to enter
6. Any person (Referrer) who purchases a Freely travel insurance product and enters the full name and key contact details in the form of an email address of an actual, living friend over the age of 18 years of age (Referred) will be eligible to receive one (1) electronic gift card to the value of AUD$20.00 provided the Referred purchases an actual policy of insurance through Freely and has not exercised any cooling off rights or otherwise cancelled or effected a refund of the policy. (Successful Nomination).
7. A Referred who uses the link to purchase a Freely travel insurance product and does not otherwise exercise any cooling off rights, cancel or effect a refund of the policy at any time will receive a 15% discount on their Freely travel insurance product.
8. Subject to a Successful Nomination, the Referrer will receive a gift card from Tango Card,Inc. (Tango) for having successfully nominated an individual. The conditions of the gift card supplied byTango are subject the terms and condition of Tango and the Referrer must comply strictly with all the conditions of use for the gift card as provided byTango.
9. A limit of one (1) gift card, will be issued to the Referrer for a Successful Nomination. Cancelled or refunded policies will not qualify as a Successful Nomination.
10. The Referrer acknowledges and agrees that they have obtained the express permission and consent of their friend and potential Referred prior to supplying any personal information to the Promoter, The Referrer indemnifies and keeps indemnified the Promoter for any breach of this representation or where any dispute about the provision of consent under privacy laws arises.
11. A Referrer and Referred who satisfy all the requirements set out in clauses 6 to 10, will be notified by email once their details are verified and the cooling off or non-cancellable period has elapsed.
12. Any gift cards and/or electronic vouchers will be sent within 28 days of the Promotor is satisfied that all of the requirements of these terms and conditions have been satisfied and the details in clause 11 have been verified to the nominated email address provided.
13. If details provided by a Referrer are found to be incomplete or inaccurate, false or untrue, then it will result in immediate forfeiture of eligibility and be deemed invalidated and both theReferrer and the Referred will be disqualified from participation in the Program.
14. The Promoter may vary, amend or cancel the Program at any time in its sole discretion by updating these terms and conditions on this website.
Gifts
15. Any gifts awarded by this Program are not redeemable or exchange for cash nor transferable and must be used in accordance with the terms and conditions of the card or voucher and within any period of validity.
16. In the event the Referrer or Referred does not take the gift by the time stipulated, then the entire gift will be forfeited, and cash will not be awarded in lieu of the gift.
17. The Promoter is not liable for any claims, actions, loss or damaged sustained by or resulting from the use of any gift or gift card awarded. The Promoter does not guarantee that the Referrer or Referred will enjoy the gift or be suited to the type of products or services to which the gift may be utilised for purchase.
Further Terms and Conditions
18. Any entrant, whether Referred orReferrer, found to have used engaged in the provision of false or fabricated information or otherwise seeks to gain an unfair advantage or to manipulate this Program will have all entries invalidated and any claim they have to any gift will be forfeited. If such an entrant is awarded a gift and then found to have breached this clause, the entrant must immediately return any gift awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
19. Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any gift will be invalidated. If such an entrant is awarded a gift and then found to have breached this clause, the entrant must immediately return any gift awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. ThePromoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
20. If the gift is unavailable, for whatever reason, the Promoter reserves the right to substitute the gift for a gift of equal or greater value, subject to State and Territory legislation. Cash will not be awarded as a substitute. It is a condition of accepting the gift that the recipient must comply with all the conditions of use of the gift and gift supplier's requirements. Each gift must be taken as stated and no compensation will be payable if a recipient is unable to use the gift as stated.
21. The Promoter cannot guarantee that any gifts returned to the Promoter due to non-delivery at the provided email address will be re-sent to the gift recipient.
22. The Promoter reserves the right to request recipients to sign a recipient’s deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency as part of proof of entry validity in order to claim a gift. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of thePromoter. In the event that a recipient cannot provide suitable proof, the recipient will forfeit the gift in whole and no substitute will be offered.
23. Subject to State and Territory legislation, the Promoter’s decision in relation to any aspect of the Program is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Gifts are subject to availability, not transferable or exchangeable and cannot be taken as cash. Gifts will be sent to the recipient’s nominated email address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this Program will take no responsibility for Gifts intercepted, mutilated, damaged or lost in transit or after receipt.
Privacy Collection statement
24. Subject to this clause 4, the Promoter and its related entities collect entrants' personal information for the purpose of conducting this Program (including but not limited to determining and notifying recipients). The Promoter may disclose personal information collected to an agent who is engaged to conduct the Program draw and for gift fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities such as regulators of trade promotions. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at http://www.covermore.com.au/covermore-privacy-policy. Copyright, Statutory guarantees, Waiver and liability
25. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received.
26. In participating in the gifts, the recipients agree to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The recipients agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the recipients (and their companions) will not be entitled to any fee for such use.
27. Gift recipientsare advised that tax implications may arise from the gift and they should seekindependent financial advice prior to acceptance of that gift. .
28. The Promoter (subject to State andTerritory legislation) reserves the right to amend, cancel or suspend this Program if an event beyond the control of the Promoter corrupts or affect the administration security, functionality or fairness, legitimacy and credibility, integrity or proper conduct of this promotion. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this promotion.In particular, computer generated entries and the use "scripting" is not permitted and will not be accepted.
29. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on theInternet service provider used.
30. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').
31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter(including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under thePromoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or gift claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a recipient or Entrant; or (f) use of a gift the Promoter (including its' officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Program including taking or using a gift, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law),including the Non-Excludable guarantees. Any change in value of the gift occurring between the publishing date and date the gift is claimed is not the responsibility of the Promoter.
